DECISION
On the promulgation of the Regulations on the functions, duties, powers, organizational structure and staffing of the Office of the People's Council and the People's Committee of Dong Hoa District

Pursuant to the Law on Organization of Local Government dated June 19, 2015;
Pursuant to the 2015 Law on Promulgation of Legal Documents;
Pursuant to Decree No. 37/2014/ND-CP dated May 5, 2014 of the Government on regulations on the organization of specialized agencies under the People's Committees of districts, towns, provincial cities;
Pursuant to Decree No. 92/2017/ND-CP dated August 7, 2017 of the Government amending and supplementing several articles of the decrees on administrative procedure control;
Pursuant to Joint Circular No. 51/2015/TTLT-BYT-BNV dated December 11, 2015, guiding the functions, duties, powers, and organizational structure of the Departments of Health under the People's Committees of provinces and centrally-run cities, and the Departments of Health under the People's Committees of districts, towns, and cities under provincial authority;
Pursuant to Decision No. 37/2016/QD-UBND dated August 2, 2016, of the Provincial People's Committee on promulgating the Regulations on the functions, duties, and powers of the Offices of the People's Councils and the People's Committees of districts, towns, and cities;
According to the proposal of the Office of the People's Council and the People's Committee of the district as per Document No. 23/TTr-VP dated September 12, 2018;
DECIDES THAT:
Article 1. Attached to this Decision is the Regulations on the functions, duties, powers, organizational structure and staffing of the Office of the People's Council and the People's Committee of Dong Hoa District.
Article 2. This Decision shall take effect after 07 days from the date of signing and shall replace Decision No. 01/2017/QD-UBND dated April 3, 2017, of the People's Committee of Dong Hoa District on the promulgation of the Regulations on the functions, duties, powers, organizational structure and staffing of the Office of the People's Council and the People's Committee of Dong Hoa District.
Article 3. The Chief of the Office of the People's Council and the People's Committee of the district, the Head of the Department of Home Affairs, and the Heads of relevant agencies and units, as well as the Chairmen of the People's Committees of the communes and towns, shall be responsible for the implementation of this Decision./.

REGULATIONS
on the functions, duties, powers, organizational structure and staffing of
the Office of the People's Council and the People's Committee of Dong Hoa District

Chapter I
POSITIONS, FUNCTIONS, DUTIES AND POWERS
Article 1. Positions and functions of the Office of the People's Council and the People's Committee of the district
1. The Office of the People's Council and the People's Committee of the district (hereinafter referred to as the Office) is a specialized agency under the People's Committee of the district, subject to the direction and management regarding organization, staffing, and operation of the People's Council and the People's Committee; at the same time, it is under the guidance, inspection, and supervision regarding professional expertise of the Provincial Office of the People's Council, Provincial Office of the People's Committee, and Department of Health.
2. The District Office of the People's Council and the People's Committee provides comprehensive advisory support to the People's Council and the People's Committee on: the activities of the People's Council and the People's Committee; advising the Chairman of the People's Committee on leadership and administration; state management regarding the control of administrative procedures; providing information to support the management and operations of the People's Council, the People's Committee, and local government agencies; ensuring the material and technical facilities for the operations of the People's Council and the People's Committee; organizing the implementation, directly managing, and directing the activities of the Reception and Result Return Unit under the one-stop-shop and interlinked one-stop mechanism in resolving administrative procedures within the jurisdiction of the district level; guiding and receiving documents from individuals and organizations in all fields within the jurisdiction of the People's Committee of the district, forwarding documents to specialized agencies under the People's Committee of the district for resolution, and receiving results to return to organizations and individuals.
- The District Office of the People's Council and the People's Committee advises the People's Committee of the district on foreign affairs. The Office also advises and assists the People's Committee of the district in performing state management functions regarding ethnic affairs and public health.
3. The District Office of the People's Council and the People's Committee possesses legal personality, along with its own seal, is allocated a budget for operations, and is authorized to open an account at the State Treasury in accordance with regulations.
Article 2. Duties and powers of the Office of the People's Council and the People's Committee of the district
The District Office of the People's Council and the People's Committee performs the duties and powers as stipulated in Decree No. 37/2014/ND-CP dated May 5, 2014, of the Government on regulations on the organization of specialized agencies under the People's Committees of districts, towns, provincial cities, and Decree No. 92/2017/ND-CP dated August 7, 2017 of the Government amending and supplementing several articles of the decrees on administrative procedure control; specifically as follows:
1. The Office assists the People's Council, the Standing Committee of the People's Council, the People's Committee, and the Chairman of the People's Committee of the district in formulating work programs and plans; organizes the monitoring, urging, and evaluation of the implementation of these programs and plans by various agencies, departments, and sectors within the district, as well as the People's Councils and People's Committees at the commune level.
The Office compiles periodic and ad-hoc reports on the outcomes of the implementation of work programs and plans; proposes solutions to enhance their effectiveness. Timely reports and advises on adjustments to work programs and plans in order to align with the management, direction and administration of the People's Council and the People's Committee.
2. The Office assists the People's Council and the People's Committee of the district in directing, inspecting and urging the implementation of work programs, plans, and legal documents issued by higher-level state management agencies, as well as those established by the People's Council and the People's Committee of the district.
3. The Office directly advises the People's Committee of the district in directing, operating and managing state affairs concerning foreign affairs and ethnic matters within the district.
4. The Office takes the lead and coordinates with agencies, units, and commune-level People's Committees to prepare drafts for proposals, reports, submissions, and other documents as assigned by the People's Council and the People's Committee of the district, ensuring compliance with quality standards and deadlines.
5. The Office is responsible for reviewing the procedures, content, forms, and authority related to documents submitted by agencies, units, and commune-level People's Committees to the People's Council and the People's Committee for approval or opinion on policy matters.
- In instances where draft documents or dossiers submitted by agencies, units and localities do not meet the required standards regarding form, content, sequence, or procedure, the Office may request the submitting agency to revise the drafts or comply with the necessary procedures as stipulated. If the submitting agency, unit, or locality does not agree with this request, the Office shall report to the Standing Committee of the People's Council and the Chairman of the People's Committee for further direction.
- The District Office of the People's Council and the People's Committee has the authority to require relevant agencies, units, or localities to provide necessary documents, information, data, or to participate in meetings to ensure adequate understanding of the situation and information that supports the management and directives of the People's Council and the People's Committee of the district.
6. The Office shall take the lead and coordinate with relevant agencies to prepare the necessary contents and conditions for organizing sessions of the People's Council, regular meetings of the People's Committee, and other conferences or working sessions of the People's Council and People's Committee of the district in accordance with legal regulations. It shall also advise and assist the Standing Committee of the People's Council in organizing monitoring sessions and interactions with voters.
7. The Office is responsible for collecting, processing, managing, and updating information to support the leadership and operation of the People's Council and the People's Committee of the district; overseeing and maintaining the operational integrity of the information network of the People's Committee.
8. The Office shall provide advice to the Chairman of the People's Committee regarding the organization and operation of the Citizen Reception Committee in compliance with legal regulations.
9. The Office will directly manage and supervise the operations of the Reception and Result Return Unit under the one-stop-shop and interlinked one-stop mechanism under the People’s Committee; guide and receive applications from individuals and organizations across all areas within the jurisdiction of the People's Committee, forwarding these applications to relevant specialized agencies for processing and returning results to applicants as per the regulations.
10. The Office is responsible for managing and utilizing the official seal and for the issuance of documents from the People's Council and the People's Committee of the district. It will organize and manage the document management and archival work of the agency in accordance with the law; implement information technology solutions to ensure the security of communication and information to support the activities of the People's Council and the People's Committee.
11. In collaboration with the Department of Home Affairs, the Office shall provide guidance on administrative office practices, document handling, and archiving for officials working in office-related roles within agencies, units, and commune-level statistical offices.
12. The Office is tasked with implementing documents, plans, and regulations issued or approved by competent authorities that pertain to the operations of the Office of the District People's Council and the People's Committee. It will receive and process documents submitted by agencies, organizations, and individuals to the Office and manage the issuance of documents in accordance with regulations. The Office will also study and apply the results of scientific research and administrative reform to support its assigned duties. It will execute anti-corruption and waste prevention measures within the scope of its management as mandated by law.
13. The Office will oversee the organizational structure, staffing, civil servant classification, and job positions; it will implement policies regarding personnel management, rewards, disciplinary measures, training, and professional development for civil servants and employees within its jurisdiction as per legal requirements and the delegation from the People's Committee.
14. The Office is responsible for managing, utilizing, and being accountable for the financial resources and assets assigned to it as per regulations. It will ensure the provision of working conditions and organizational support for the activities of the People's Council, the People's Committee, the Standing Committee of the People's Council, various committees of the People's Council, the Chairman, and Vice-Chairmen of the People's Committee, as well as the Office itself, in accordance with the established protocols.
15. The Office shall present proposals to the People's Committee of the district and the Chairman for the issuance of decisions, long-term plans, five-year plans, annual plans, and other documents; it shall also develop programs and measures to implement state administrative reform tasks that fall within the jurisdiction of the People's Council and the People's Committee in the healthcare sector.
16. The Office is responsible for executing legal documents, plans, and regulations after approval, as well as informing, propagating, disseminating, educating, and monitoring the enforcement of laws within its area of responsibility.
17. The Office shall assist the People's Committee of the district in implementing and taking responsibility for the evaluation, registration, and issuance of various permits and certificates in the healthcare sector as mandated by law and according to the delegation from the People's Committee.
18. The Office shall assist the People's Committee of the district in state management of enterprises, collective economic organizations, and private enterprises; provide guidance and oversight for associations and non-governmental organizations operating in the healthcare sector in accordance with legal regulations.
19. The Office will offer specialized guidance and professional training related to the areas under its management for officials and civil servants at the commune and township levels.
20. The Office shall facilitate the application of scientific and technological progress; develop information systems and archives to support state management and professional activities within its designated areas
21. The Office is responsible for providing regular and ad hoc reports and information on the implementation of its assigned duties as per the requirements of the People's Committee of the district and the Department of Health.
22. The Office will conduct inspections and participate in audits concerning organizations and individuals to ensure compliance with legal regulations, as well as to address complaints and denunciations within the healthcare sector.
23. The Office shall perform other tasks and responsibilities as assigned by the People's Council and the People's Committee of the district, or as stipulated by law.
Chapter II
ORGANIZATIONAL STRUCTURE, STAFFING AND OPERATIONAL PRINCIPLES
Article 3. Leadership of the Office of the People's Council and the People's Committee of the district
1. The leadership of the Office of the People's Council and the People's Committee of the District consists of the Chief of Office and no more than 02 Deputy Chiefs of Office.
2. The appointment of the Chief and Deputy Chiefs of Office shall be decided by the Chairman of the District People's Committee in accordance with legal provisions and the management delegation framework.
Article 4. Staffing
The staffing and number of personnel at the Office of the People's Council and the People's Committee of the District shall be assigned based on job positions, linked to functions, tasks, and workload, and shall fall within the total staffing allocation of the People's Committee of the District as delegated by the Provincial People's Committee.
The arrangement and utilization of civil servants and employees in the Office of the People's Council and the People's Committee of the District must be based on job positions, titles, and professional standards in accordance with legal regulations, ensuring efficiency and streamlined operations.
Article 5. Work regime and responsibilities
1. The Office of the People's Council and the People's Committee of the district operates under a centralized management regime and in compliance with the principle of democratic centralism
2. The Chief of the Office is the head, responsible to the People's Council, the People's Committee of the district, and the law for all activities of the Office; he/she is the account holder of the Office.
3. The Deputy Chief of the Office, assigned specific tasks and oversight by the Chief, is accountable to the Chief and the law for the assigned duties. The Deputy Chief is authorized to handle the Chief’s responsibilities when delegated but may not further delegate those responsibilities to others.
4. Officials and staff of the Office must comply with the management, direction, and task assignments from the Chief and the responsible Deputy Chief. They must strictly adhere to the working regulations, internal rules, and discipline of the agency, and are accountable to the Chief and the responsible Deputy Chief, as well as to higher authorities and the law for their assigned duties.
5. The Office shall conduct monthly coordination meetings to evaluate the results of assigned tasks and implement work plans and related documents concerning the organization and operations of the Office.
6. The Office of the People's Council and the People's Committee of the district is responsible for matters of advice and proposals within its remit as specified.
7. Specialists and leaders of the Office of the People's Council and the People's Committee of the district are accountable for their advisory opinions and proposals.
Article 6. Operational relationships
The Office of the People's Council and the People's Committee of the district shall consistently maintain working relationships with the Office of the Provincial People's Council and the Provincial Office of the People's Committee and the Department of Health; establish cooperative relationships with district agencies and units, the District Party Committee Office, the Standing Committee of the Fatherland Front Committee, and various district organizations; the People's Council and the People's Committee of the communes, wards, and towns, and other related agencies and units to provide information and assist the People's Council, advising the People's Committee of the district in its leadership and management responsibilities as per its authority.
Chapter III
ENFORCEMENT
Article 7. Enforcement
The Chief of the Office of the People's Council and the People's Committee of the district and the Heads of related agencies and units are responsible for implementing these Regulations. Should there be any amendments or supplements to functions and duties during the execution of these Regulations, proposals must be submitted to the People's Committee of the district for consideration to amend and supplement these Regulations accordingly.
