REGULATIONS

ON THE FUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE AND STAFFING OF DONG HOA DISTRICT INSPECTORATE

dated June 16, 2015 by the People’s Committee of Dong Hoa District)

Chapter I

POSITIONS, FUNCTIONS, DUTIES AND POWERS

          Article 1. Positions and functions

          1. The District Inspectorate is a specialized agency under the Dong Hoa District People's Committee, tasked with advising and assisting the District People's Committee in the management of state affairs concerning inspection, complaint resolution, whistleblowing, and anti-corruption efforts. It conducts inspections and addresses complaints and accusations, as well as implements anti-corruption measures in accordance with legal regulations;

 2. The District Inspectorate has its own seal and separate bank account. It operates under the direction and management of organizational structure, staffing and operation by the District People's Committee, specifically reporting directly to the Chairman of the District People's Committee. At the same time, it is subject to the operational guidance and professional oversight of the Provincial Inspectorate.

Article 2. Duties and powers

          The District Inspectorate carries out its duties and exercises its authority in accordance with legal regulations concerning inspections, resolution of complaints and accusations, anti-corruption efforts, and specific responsibilities and powers as follows:

1. Submit proposals to the District People's Committee for the issuance of decisions and directives related to inspection, complaint resolution, whistleblowing, and anti-corruption efforts; outline programs and measures to implement tasks pertaining to administrative reforms within the scope of assigned state management;

2. Present the annual inspection plan and other programs and plans to the Chairman of the District People's Committee in accordance with legal provisions;

3. Organize the implementation of legal documents, programs, and plans after they have been approved by the District People's Committee or the Chairman of the District People's Committee;

4. Provide information, disseminate, and educate on legal matters related to inspections, complaint resolution, whistleblowing, and anti-corruption; guide professional and technical aspects of inspection, complaint resolution, whistleblowing, and anti-corruption for officials and civil servants at the commune and town levels;

5. Guide, inspect, and urge the Chairmans of communes and towns, as well as the Heads of specialized agencies under the District People's Committee, in the implementation of laws related to inspections, complaint resolution, whistleblowing, and anti-corruption efforts;

          6. Collaborate with the Vietnam Fatherland Front Committee at the district level to provide professional guidance for the People's Inspectorate committees at the commune and town levels;

          7. Regarding inspection responsibilities:

          a) Conduct inspections on the implementation of policies, laws, and duties of the People's Committees of communes and towns, as well as specialized agencies under the District People's Committee; inspect complex cases involving multiple communes and towns, several specialized agencies under the District People's Committee, and other relevant units according to the approved plan or spontaneously upon detection of signs of legal violations;

b) Inspect other cases as assigned by the Chairman of the District People's Committee;

c) Monitor, check, and urge the implementation of conclusions, recommendations, and decisions regarding inspections made by the District Inspectorate and the Chairman of the District People's Committee;

8. Regarding complaint and whitstleblowing resolution:

a) Guide the People's Committees of communes and towns, as well as agencies, organizations, and units under the management of the District People's Committee, in the process of receiving citizens, handling complaint and whistleblower submissions, and resolving these complaints;

b) Inspect and check the responsibilities of the Chairmen of the People's Committees of communes and towns, and the Heads of agencies, organizations, and units under the management of the District People's Committee in receiving citizens and resolving complaints and accusations; recommend measures to enhance complaint and whistleblower resolution efforts within the management scope of the Chairman of the District People's Committee;

c) Verify, conclude, and recommend solutions for complaint and whistleblower cases falling under the authority of the Chairman of the District People's Committee when assigned;

d) Review and conclude the resolution of complaints and accusations resolved by the Chairmen of the People's Committees of communes and towns and the heads of specialized agencies under the District People's Committee that show signs of legal violations; if there is evidence suggesting a violation of the law in the resolution of accusations, recommend that the Chairman of the District People's Committee reconsider and address the issue in accordance with regulations;

dd) Monitor, check, and urge the implementation of decisions resolving complaints, conclusions regarding the contents of accusations, and decisions on accusations by the Chairman of the District People's Committee;

e) Receive and handle complaint and whistleblower submissions; resolve complaints and accusations falling under the authority in accordance with legal provisions.

9. Regarding anti-corruption:

a) Inspect and check the implementation of legal provisions on anti-corruption by the People's Committees of communes and towns, as well as agencies and units under the management of the District People's Committee;

b) Collaborate with the State Audit Office, investigative agencies, the People's Procuracies, and the People's Courts in detecting acts of corruption and addressing individuals involved in corrupt activities;

c) Conduct verification of asset and income declarations according to the legal provisions on anti-corruption; compile results of declarations, publicize, verify, conclude, and address violations related to asset and income transparency within the locality, and periodically report results to the Provincial Inspectorate;

d) Perform internal checks and monitoring to prevent corrupt acts in inspection, complaint resolution, and anti-corruption activities.

10. In the course of carrying out inspection duties, resolving complaints and accusations, and implementing anti-corruption measures, the Dong Hoa District Inspectorate exercises its authority as stipulated by law; it has the right to request relevant agencies and units to assign officials and civil servants to participate in inspection delegations, complaint resolutions, and anti-corruption activities.

11. Organize the application of scientific and technological advancements; build an information and storage system to support state management and the professional work of the District Inspectorate. 

12. Compile, inform, and report results of inspection work, complaint resolution, and anti-corruption activities as prescribed by the District People's Committee and the Provincial Inspectorate.

13. Manage civil servant staffing, implement regimes, policies, rewards, disciplinary measures, training, and professional development for civil servants under the management of the District Inspectorate in accordance with legal provisions and the delegation of authority from the District People's Committee.

14. Manage and utilize financial resources and assets assigned according to legal provisions and the delegation of authority from the District People's Committee.

15. Execute other tasks assigned by the District People's Committee and according to legal regulations.

Chapter II

ORGANIZATIONAL STRUCTURE AND STAFFING

Article 3. Organizational structure

1. The District Inspectorate consists of the Chief Inspector, no more than 02 Deputy Chiefs, and inspectors and specialized civil servants.

a) The Chief Inspector is the head of the District Inspectorate and is responsible to the District People's Committee, the Chairman of the District People's Committee, and the law for all activities of the District Inspectorate.

- The appointment and reappointment of the Chief Inspector of the District are decided by the Chairman of the District People's Committee based on the professional standards established by the Provincial People's Committee, after consultation with the Chief Inspector of the Province;

- The dismissal or removal of the Chief Inspector of the District is also decided by the Chairman of the District People's Committee according to legal regulations and after consultation with the Chief Inspector of the Province.

b) The Deputy Chief Inspector assists the Chief Inspector and is responsible to the Chief Inspector and the law for the assigned tasks.

- The appointment and reappointment of the Deputy Chief Inspector of the District are decided by the Chairman of the District People's Committee according to the regulations and the professional standards established by the Provincial People's Committee, based on the recommendation of the Chief Inspector.

The dismissal or removal of the Deputy Chief Inspector of the District is decided by the Chairman of the District People's Committee according to legal regulations and based on the recommendation of the Chief Inspector.

c) Inspectors and specialized civil servants: Their specific duties are assigned by the Chief Inspector; they are responsible to the Chief Inspector, the directly managing Deputy Chief Inspector, and the law for the tasks assigned to them.

d) Rewards, discipline, and other policies regarding the Chief Inspector and Deputy Chief Inspector are implemented according to legal regulations.

2. The staffing of civil servants in the District Inspectorate is assigned by the Chairman of the District People's Committee based on job positions associated with functions, duties, areas of activity, and within the total civil servant staffing of the administrative agencies of the district as assigned by the Provincial People's Committee.

3. Based on its functions, duties, job position list, and the structure of civil servant ranks approved by competent authorities, the District Inspectorate develops an annual plan for civil servant staffing according to legal provisions to ensure the execution of its assigned tasks.

Chapter III

ORGANIZATION FOR IMPLEMENTATION

Article 4. The Chief Inspector of the District and the Heads of relevant agencies and units are responsible for implementing these Regulations. During the implementation process, if there are any changes or additions to functions or duties, they shall propose to the District People's Committee to amend and supplement these Regulations accordingly./.
