On organization and operation of Vocational Education - Continuing Education Center of Dong Hoa district

Chapter I

POSITIONS AND FUNCTIONS

 

Article 1. Subjects and scope of application

This Regulation regulates the organization and operation of the Vocational Education - Continuing Education Center of Dong Hoa district.

Article 2. Legal status

The District Vocational Education and Continuing Education Center is a public service unit (abbreviated as the Center) with the functions of vocational training, continuing education, career guidance and job referral; has autonomy and self-responsibility according to the provisions of law; has legal status, its own seal and account for operation.

The Center is under the direct direction and management of the District People's Committee in terms of organization, professional titles and operations, and is also under the professional and technical guidance of the Department of Education and Training and the Department of Labor, War Invalids and Social Affairs.

Chapter II

DUTIES AND POWERS

Article 3. Duties

1. Organize training of human resources directly for production, business and services at the elementary level, vocational training under 03 months; training in the form of vocational mentoring, vocational training, apprenticeship; training, fostering and improving vocational skills for employees in enterprises; fostering and perfecting vocational skills for employees; vocational training for rural workers and organizing the implementation of policies to support elementary level training and training under 03 months.

2. Organize the implementation of regular education programs including: literacy and continuing education programs after literacy; education programs to meet learners' requirements, update knowledge, skills, transfer technology; training programs, fostering and improving professional and technical qualifications; education programs to obtain degrees from the national education system.

3. Organize the development and implementation of programs, textbooks, and learning materials at the elementary level, under 3 months for permitted occupations; training programs, professional and technical qualifications improvement, knowledge and skills update, technology transfer.

4. Develop enrollment plans, organize enrollment.

5. Manage staff, teachers, employees and learners according to the provisions of law and the District People's Committee.

6. Organize production labor and technical services to serve training.

7. Research and apply scientific topics on vocational education, continuing education and career guidance, test, apply and transfer new technologies to serve the socio-economic development of the locality.

8. Organize teaching and learning activities; test and grant certificates according to regulations.

9. Provide career counseling and job counseling for learners; Coordinate with junior high schools and high schools to promote, guide and direct students.

10. Coordinate with businesses, organizations, individuals and families of learners in vocational training, continuing education and career guidance activities; organize for learners to visit, practice and intern at enterprises.

11. Implement democracy and transparency in the implementation of vocational training, continuing education and career guidance tasks.

12. Manage and use land, facilities, equipment and finance according to the provisions of law and the District People's Committee.

13. Create conditions or organize training and fostering for civil servants, teachers, employees and learners to study and improve their professional qualifications and skills.

14. Implement the periodic and ad hoc reporting regime according to regulations.

15. Perform other tasks according to the provisions of law and the District People's Committee.

Article 4. Powers

1. Proactively develop and organize the implementation of strategies for developing vocational training, continuing education, career guidance and job referrals in accordance with the needs of human resource development in the district, meeting the requirements of the labor market.

2. Organize training programs in accordance with the provisions of law.

3. Enter into joint ventures and partnerships with domestic enterprises, organizations, individuals and foreign organizations and individuals to organize training, supplementary training and vocational skills development in accordance with the provisions of law.

4. Mobilize, receive funding, manage and use resources in accordance with the provisions of law, in order to carry out the activities of the Center.

5. Organize production, business and services in accordance with the provisions of law;

 

6. Use revenue from economic activities to invest in building facilities, spending on training activities and supplementing the financial resources of the Center.

 

7. Exercise other autonomous rights as prescribed by law and the District People's Committee.

 

Chapter III

ORGANIZATIONAL STRUCTURE AND PERSONNEL

Article 5. Organizational structure and staffing

The organizational structure of the Vocational Education - Continuing Education Center includes:

1. Director and no more than 02 Deputy Directors.

2. Professional and technical groups include:

a) Education Group;

b) Administration - General Group;

c) Vocational Training - Career Guidance Group;

d) Continuing Education Group.

dd) Production, service and vocational training service groups. The establishment and operation of production, business, service and training service groups of the Center are implemented in accordance with the provisions of law.

3. The professional title (Staffing) of the Center is the Education and Training career staff assigned by the District People's Committee within the total Education and Training career staff assigned by the Provincial People's Committee to the District People's Committee.

Article 6. Standards, conditions and authority to appoint Director and Deputy Director of the Center

1. The Director and Deputy Director of the Center must have good qualities, ethics, and a clear background; have a university degree or higher, be in good health, and have undergone training in leadership and management skills and capacity; and meet the prescribed conditions and standards.

2. Authority: The appointment, reappointment, transfer, rotation, reward, discipline, and implementation of regimes and policies for the Director and Deputy Director of the Center shall be decided by the Chairman of the District People's Committee in accordance with the provisions of law and the management decentralization of the competent authority.

Article 7. Duties and powers of the Center Director

The Director is the head of the Center, represents the Center before the law, is responsible for managing and operating the Center's activities, has duties and powers as prescribed in Clause 3, Article 13 of the Law on Vocational Education, Clause 5, Article 13 of the Regulations on organization and operation of the Continuing Education Center issued by the Ministry of Education and Training and related legal documents; is responsible before the law, the District People's Committee, and the Chairman of the District People's Committee for all activities of the Center according to regulations.

1. Duties:

a) Develop and organize the implementation of training and development plans;

b) Manage the Center's facilities, assets, and finances and organize the effective exploitation and use of mobilized resources to serve training activities in accordance with the provisions of law and the District People's Committee;

c) Regularly take care of improving working, teaching, and learning conditions for staff, employees, teachers, and students;

d) Direct the construction of a healthy pedagogical environment; ensure political security and social order in the Center;

dd) Implement democratic regulations; implement policies for officials, teachers, employees, and students;

e) Organize democratic regulations; state policies and regimes for officials, teachers, employees, and students;

g) Fully and promptly implement the periodic and ad hoc reporting regime in accordance with the provisions of law and the District People's Committee;

h) Perform other tasks as prescribed by law and the District People's Committee;

g2. Powers:

a) Decide on measures to implement the tasks and powers of the Center as prescribed in Articles 3 and 4 of this Regulation.

b) Decide on the establishment of professional and technical groups; production, business, services, and vocational training services according to the organizational structure of the Center approved by the competent authority.

c) Decide on the appointment of the Heads and Deputy Heads of professional and technical groups; production, business, services, and vocational training services;

d) Decide on the conclusion of labor contracts with civil servants, teachers, employees, and learners in accordance with the provisions of law and the District People's Committee;

dd) Sign professional, supplementary, and training contracts with learners in accordance with the provisions of law and the District People's Committee;

e) Sign a contract of association with other vocational training institutions; production and service business establishments in training, supplementary training, fostering, practice, internship or production and service business organizations, according to the provisions of law and the District People's Committee;

g) Grant certificates, transcripts, and certificates of academic qualifications to students at the Center according to regulations;

h) Decide on rewards and disciplines for civil servants, teachers, employees and learners within the scope of authority delegated to the District People's Committee;

i) Be entitled to the regimes according to regulations.

Article 8. Duties and powers of the Deputy Director of the Center

1. Assist the Director in managing and operating the Center's activities, directly in charge of a number of work areas as assigned by the Director and handle other tasks assigned by the Director.

2. When handling work assigned by the Director, the Deputy Director, on behalf of the Director, is responsible before the law and the Director for the results of the assigned work.

3. Be entiled to the regimes according to regulations.

Article 9. Emulation Council, Scientific Council of the Center

Based on the requirements of management and operation, the Director of the Center establishes the Emulation Council and the Scientific Council according to the provisions of law;

The functions, duties, powers, composition, working regime and operating time of the Councils are prescribed by the Director of the Center based on the provisions of law.

 

 

Chapter IV

OPERATIONAL ORGANIZATION

 

Article 10. Forms of study

1. Forms of study at the Center include: Concentrated study, work-study, distance learning, self-study with guidance.

2. The Center trains occupations at basic and elementary levels according to the requirements of the labor market. Every year, based on the training needs of technical human resources directly in production and services of the labor market, the Center promptly adjusts the scale and training occupations of the Center.

 

Article 11. Classroom organization

1. Students study at the Center in the form of concentrated study, work-study organized by class. Each class has a homeroom teacher; a class monitor, one or two deputy class monitors. The class monitor and deputy class monitor are elected by the class.

2. Students study at the Center in the form of distance learning, self-study with guidance implemented according to separate regulations.

Article 12. Textbooks and learning materials

1. Continuing education, career guidance: Use textbooks and learning materials according to the regulations on programs, curricula, textbooks, continuing education materials of the Ministry of Education and Training, learning materials specific to the locality as prescribed by the Department of Education and Training or competent state management agencies.

2. Vocational training:

a) Organize the development and promulgation of elementary vocational training programs and regular vocational training programs of the Center;

b) Vocational training must regularly evaluate, update, and supplement vocational training programs and curricula in accordance with production and service techniques and technologies;

c) Organize the compilation and promulgation of vocational training curricula or use vocational training curricula of other vocational training institutions according to the provisions of law.

Article 13. Enrollment

1. The Center develops an annual enrollment and training plan based on the needs of learners and direct human resources in local production, business and services, in accordance with the training capacity of the Center.

2. Organize enrollment and training according to the enrollment and training regulations issued by the Ministry of Education and Training, the Ministry of Labor, War Invalids and Social Affairs and the District People's Committee.

Article 14. System of books to monitor educational activities of the Center

Comply with current regulations of the Ministry of Education and Training, the Ministry of Labor, War Invalids and Social Affairs and other superior management agencies.

Article 15. Testing, evaluation and classification of learning outcomes

Carry out testing and evaluation of learning, training and development results of learners according to the regulations on examination, testing and graduation recognition issued by the Ministry of Education and Training and the Ministry of Labor, War Invalids and Social Affairs.

 

Chapter V

TEACHERS, STAFF

 

Article 16. Teachers of the Center

Teachers of the Center are those responsible for teaching, educating, training and participating in teaching the programs specified in Article 3 of this Regulation.

Article 17. Duties of teachers

1. Carry out teaching tasks according to the objectives, contents, educational programs, teaching plans; manage students according to the assignment of the Center Director. For teachers working under labor contracts, they must strictly implement the contents stated in the labor contract signed with the Center;

2. Strictly implement the technical, professional, and occupational safety and hygiene standards of the Center;

3. Implement the decisions of the Director, the provisions of the law and the provisions of this Regulation.

4. Practice ethics, foster expertise and skills to improve the quality and effectiveness of teaching;

5. Maintain the qualities, prestige and honor of teachers; unite and help colleagues; be a good example to students, respect their personality and treat students fairly; protect the rights and legitimate interests of students;

6. Maintain and protect equipment, teaching aids, teaching materials and other documents of the Center.

Article 18. Rights of teachers

1. Be assigned to teach in accordance with the major and assigned plan. Be entitled to the benefits of teachers according to the provisions of law.

2. Be able to choose teaching methods and means to promote personal capacity, improve training quality and effectiveness.

3. Be able to use textbooks, documents, vocational training materials, and technical facilities of the Center to perform teaching tasks.

4. Be trained and fostered to improve professional qualifications and tasks according to the provisions of law. Be able to go to production practice and access new technology.

5. Be respected for honor and dignity. Be able to participate in discussions, debates, and give opinions on the unit's development policies and plans, develop programs, textbooks, content, teaching methods, and issues related to the rights and legitimate interests of teachers.

6. Be contracted to teach and conduct scientific experiments at other educational institutions, but must ensure the fulfillment of the duties of a teacher, as prescribed in Article 20 of this Regulation.

7. Be allowed to directly or through their organization to participate in the management of the Center.

8. Be allowed to participate in scientific research activities, production labor, and technology transfer services organized by the Center.

9. Be allowed to attend meetings of the Reward Council and Disciplinary Council when these Councils resolve issues related to students in the class they are assigned to and responsible for.

10. Be entitled to other legitimate benefits according to the provisions of law.

11. Teachers performing educational and training tasks have teaching and part-time work hours according to the provisions of law.

Article 19. Standard training qualifications of teachers

1. Teachers of the Center participating in teaching programs to obtain diplomas and certificates of the national education system must have the standard qualifications as prescribed for teachers teaching the same level of formal education, specifically as follows:

a) Have a diploma of secondary pedagogy for teachers teaching literacy programs and continuing education after literacy;

b) Have a college degree in pedagogy or a college degree and a certificate of pedagogical training for teachers teaching continuing education programs at the junior high school level;

c) Have a university degree in pedagogical education or a university degree and a certificate of pedagogical training for teachers teaching continuing education programs at the high school level;

d) Have a vocational intermediate degree, a college degree or be a skilled craftsman or technical worker for teachers instructing vocational practice;

dd) Have a college or university degree majoring in Foreign Languages ​​or Information Technology for teachers teaching advanced training programs for Foreign Languages ​​and Information Technology.

2. Standard qualifications of vocational teachers

a) Teachers of elementary vocational theory

- Teachers of elementary vocational theory must have a diploma from a technical pedagogical intermediate level, vocational intermediate level or higher;

- Vocational teachers who do not have a diploma from a technical pedagogical intermediate level or higher must have a vocational teaching certificate;

- Have a vocational skills certificate from level 2 or higher.

- Foreign languages: Level A.

- Information technology: Level A or Office information technology.

b) Practical teachers:

- Practical teachers must have a diploma from a vocational intermediate level or higher or be artisans or highly skilled people.

- Vocational teachers who do not have a diploma from a technical pedagogical intermediate level or higher must have a vocational teaching certificate.

- Have a vocational skills certificate from level 2 or higher.

- Foreign language: Level A.

- Information technology: Level A or Office information technology

c) Contract teachers are signed by the Center Director according to regulations.

Article 20. Duties and powers of civil servants and employees

Civil servants and employees working in management and service at the Center are obliged to strictly perform assigned tasks and responsibilities; and be entitled to benefits according to the provisions of law and in the labor contract.

 

Article 21. Recruitment of civil servants, teachers and employees

The recruitment of civil servants, teachers and staff must meet the standards of professional knowledge, skills and job positions. The recruitment must be democratic, public, fair and implemented in accordance with the provisions of the law on recruitment of civil servants and public employees, the Labor Code and the District People's Committee.       

 

Chapter VI

STUDENTS

 

Article 22. Students of the Center  

1. Continuing Education and Career Guidance students are students who are studying one or more programs of the Center;

2. Vocational students are students who need to study elementary, supplementary, vocational training, and intermediate vocational training and meet the conditions prescribed by law, and are signed a vocational training contract with the Director of the Center.

Article 23. Duties of students   

1. Study and practice according to the training program and plan of the Center.

2. Respect teachers, staff and employees; unite and help each other in studying; strictly follow the rules and regulations of the Center, fully comply with the laws of the State.

3. Pay tuition fees as prescribed.

4. Participate in labor and social activities, environmental protection activities.

5. Preserve and protect the assets of the Center and the production facility where the practice is carried out.

6. Comply with regulations on occupational safety and hygiene.

7. Fulfill the obligation to work for a limited period of time as prescribed by law.

8. Practice a cultural lifestyle in communication and behavior.

Article 24. Rights of students

1. Be respected and treated equally by the Center, and be provided with full information about your studies.

2. Be allowed to choose a study program, form of study, and place of study that is suitable to students’ abilities, conditions, and the Center; be given the opportunity to change study program, form, and place of study if they wish and are accepted by the place they are transferring to.

3. Participate in the activities of unions and social organizations in the Center according to the provisions of law.

4. Directly or through a legal representative to protect their legitimate rights, give comments on the content, teaching methods, and other activities of the Center.

5. Receive a portion of the results of production labor, technical practice, and other activities in which they participate; be considered for scholarships or social subsidies according to the provisions of law.

6. Students who complete the continuing education programs according to the provisions of this Regulation will be granted diplomas and certificates according to the regulations.

 

Chapter VII

ASSETS AND FINANCES

 

Article 25. Asset and financial management

1. The Center shall manage assets and finances in accordance with the provisions of Decree No. 43/2006/ND-CP dated April 24, 2006 of the Government until the People's Committee of Phu Yen province implements Decree No. 16/2015/ND-CP dated February 14, 2015 of the Government regulating the autonomy mechanism of public service units and other relevant legal provisions.

2. The management of the Center's assets must comply with the State's regulations. Civil servants, public employees, teachers and employees of the Center are responsible for preserving and protecting the Center's assets.

3. The management of the Center's revenue and expenditure of financial resources must comply with the current regulations of the State; fully and strictly comply with the accounting, statistical and periodic reporting regimes as prescribed.

 

Chapter VIII

WORKING RELATIONS OF THE CENTER

 

Article 26. For enterprises, production and business establishments and other training establishments

1. The Center actively coordinates vocational training activities with socio-political organizations, socio-professional organizations, other social organizations, schools in the district and People's Committees of communes and towns to meet the needs of technical human resources directly involved in production of enterprises and the labor market.

2. Actively cooperates in training with reputable facilities to meet the needs of learners.

Article 27. Relationship between the Center and the students’ families

1. Every year, the Center is responsible for publicly announcing the plan, enrollment targets, standards, and policies and regimes for students.

2. Actively coordinate with students' families to do a good job of education, aiming to comprehensively develop students' personalities.

Article 28. Relationship between the Center and local socio-political organizations and social organizations

1. The Center coordinates with local socio-political organizations, socio-professional organizations and other social organizations to implement the contents of the joint activity programs to support and create favorable conditions for everyone, of all ages and economic sectors to participate in learning;

2. Encourage organizations and individuals to support the Center materially and spiritually, participate in building the movement of regular learning, lifelong learning and building a learning society.

Chapter IX

IMPLEMENTATION PROVISIONS

Article 29. The Director of the Dong Hoa District Vocational Education - Continuing Education Center is responsible for organizing the implementation of this Regulation. If any problems arise or need to be amended or supplemented, the functions, duties, powers, and organizational structure of the Center shall coordinate with the Head of the District Internal Affairs Department to propose to the District People's Committee for consideration and decision accordingly./.
