REGULATIONS

On the functions, duties, powers, organizational structure and staffing of the Department of Economic Affairs of the Town

 (Issued together with Decision No. 04/2020/QD-UBND

dated September 17, 2020 by the People’s Committee of Dong Hoa town)

 

Chapter I

FUNCTIONS, DUTIES AND POWERS

Article 1. Positions and functions

1. The Department of Economic Affairs is a specialized agency under the People's Committee of the town, responsible for advising and assisting the town's People's Committee in performing its state management functions related to: Agriculture; forestry; salt production; irrigation; fisheries; disaster prevention and control; quality and food safety concerning agricultural products, forestry products, seafood, and salt; rural development; household economic development; rural farm economy; cooperative economies in agriculture, forestry, fisheries, and salt production linked to local industries and crafts; science and technology; handicrafts; industry; trade; and some duties and powers as delegated by the town's People's Committee and according to legal regulations, ensuring unified management of the industry and fields of work within the town.

2. The Department of Economic Affairs has legal status, a seal, and a separate account; it is subject to the direction and management regarding organization, job positions, civil servant staffing, civil servant grading structure, and operations of the town's People's Committee; it is under the direction, guidance, and inspection regarding expertise from the Department of Agriculture and Rural Development, the Department of Science and Technology, the Department of Industry and Trade, and other relevant departments and agencies.

          Article 2. Duties and powers

1. Present to the People's Committee of the town the issuance of decisions and directives; long-term plans, 5-year plans, and annual plans for the development of industry and trade within the town; science and technology as part of the socio-economic development plan of the locality; programs to encourage the development of agriculture, forestry, salt production, fisheries, irrigation, rural development, disaster prevention and control; and measures ensuring the quality and safety of food for approval by the People's Council; as well as programs and measures for organizing the implementation of administrative reform tasks within the scope of state management assigned.

2. Present draft documents to the Chairman of the People's Committee of the town regarding the specialized fields of agriculture and rural development; industry and trade; and science and technology that fall under the authority of the Chairman.

3. Organize the implementation of legal normative documents, approved plans, and technical standards in specialized fields; provide information, conduct public awareness campaigns, and disseminate legal knowledge on the areas under management; and monitor the enforcement of laws.

4. Regarding agriculture and rural development

a) Organize the implementation of production development in agriculture, forestry, fishery, and salt production; as well as disaster prevention and control of pests and diseases in the area;

b) Coordinate to protect dikes, small and medium irrigation works; aquaculture facilities; rural water supply and drainage systems; disaster prevention structures; and manage the irrigation network in the area according to legal regulations;

c) Serve as the focal point for organizing and guiding the implementation of content related to rural development; compile information and report to the People's Committee of the town on rural construction and development in the town regarding the following areas: Household economic development, farms, cooperative economies, agricultural cooperatives; development of rural trades and traditional crafts; exploitation and use of clean water in rural areas; processing of agricultural, forestry, fishery products, and salt; guide and supervise the implementation of land allocation, resettlement in agriculture and rural areas;

d) Organize statistical activities to meet management requirements as prescribed; statistics on the status of agricultural land, forestry land, salt production land, aquaculture water areas, and forest resources; implement appropriate farming measures to exploit and utilize land and water resources effectively for agricultural production, aquaculture, and salt production;

dd) Manage the quality and supplies of agricultural products, food safety for agricultural, forestry, fishery products, and salt in the area according to legal regulations;

e) Manage service activities supporting the development of agriculture, forestry, salt production, and aquaculture; supplies for agriculture and forestry, fertilizers, and animal feed within the town;

f) Oversee agricultural extension services, forestry extension, fishery extension, and salt production extension, as well as development projects in agriculture, forestry, salt production, aquaculture, irrigation, and rural development in the town according to regulations;

g) Carry out the responsibilities of a standing office for flood and storm prevention and control; planning for forest protection and development; building new rural areas; ensuring clean water and sanitation in rural areas; combating desertification; and preventing diseases in agriculture, forestry, and aquaculture within the town.

5. Regarding industry and trade

a) Organize, guide, and implement policies to encourage collective and private economic organizations to invest in industrial development and expand production and business; organize advisory services for technology transfer, provide information, promote trade, and train human resources for production and business establishments in the field of industry and trade;

b) Advise and assist the People's Committee of the town in exercising state management over industrial clusters within the town; participate in developing plans for the growth of industrial clusters in the town; prepare documentation for the establishment, expansion, and supplementation of industrial cluster planning in the town; create detailed plans and investment project proposals for the construction and organization of industrial clusters in the town after receiving approval from the competent authorities.

c) Assist the People's Committee of the town in conducting assessments, registrations, and issuing various licenses within the responsibilities and authority of the department according to legal regulations and as assigned by the People's Committee of the town.

d) Assist the People's Committee of the town in exercising state management over collective and private economic organizations, and guide and supervise the activities of associations and non-governmental organizations in the field of industry and trade according to legal regulations.

6. Regarding science and technology

a) Submit to the Chairman of the People's Committee of the town for the establishment of a Scientific and Technological Advisory Council in accordance with the provisions of the Law on Science and Technology and the decentralization of the provincial People's Committee;

b) Manage and implement scientific and technological tasks funded by the state budget at the local level; organize the application of scientific and technological advancements; promote a culture of creative labor; disseminate and select the results of scientific research and technological development, inventions, technical innovations, and production improvements for application in the locality; organize the provision of scientific and technological services within the area;

c)  Organize the implementation of legal regulations on standards, measurement, and product quality; inspect the measurement and quality of products and goods within the locality;

d) Implement legal documents and plans related to science and technology after they have been issued and approved; provide information, statistics, advocacy, guidance, dissemination, and legal education in the field of science and technology; offer professional guidance on scientific and technological management to officials and civil servants at the commune, ward, and town levels.

7. Provide professional guidance and expertise in the areas managed by the Department to commune-level officials regarding agriculture and rural development; industry and trade; science and technology.

8. Assist the People's Committee of the town in exercising state management over collective and private economic organizations, and guide and inspect the activities of associations and non-governmental organizations operating in the assigned management areas within the locality.

9. Organize the implementation and application of scientific and technological advancements; develop an information and storage system to support state management and the professional tasks of the Department. Ensure the submission and archiving of documents and records under the management authority of the People's Committee of the town in accordance with legal regulations.

10. Lead and collaborate with relevant agencies to inspect and supervise the enforcement of laws related to industry and trade and compliance with policies and laws regarding science and technology within the locality; inspect the implementation of legal regulations concerning agriculture, forestry, salt production, fisheries, irrigation, and rural development for organizations and individuals within the management area; resolve complaints and denunciations; prevent and combat corruption and waste in accordance with legal regulations and the assignments of the People's Committee of the town.

11. Carry out information work and report periodically and unexpectedly on the status of the implementation of assigned tasks in the fields of agriculture, forestry, salt production, fisheries, irrigation, and rural development; in the field of industry and trade, and the operational status of science and technology as required by the People's Committee of the town, the Department of Agriculture and Rural Development, the Department of Industry and Trade, and the Department of Science and Technology.

12. Manage the organizational structure, job positions, civil servant staffing, civil servant grading structure, and implement policies, rewards, disciplinary measures, training, and professional development for civil servants under the Department in accordance with legal regulations and as assigned or delegated by the People's Committee of the town.

13. Manage and be responsible for the finances and assets of the Department in accordance with legal regulations and under the direction of the People's Committee of the town.

14. Perform other tasks related to state management in sectors and fields assigned by the People's Committee of the town or the Chairman of the People's Committee of the town, or as stipulated by law.

Chapter II

ORGANIZATIONAL STRUCTURE AND STAFFING

Article 3. Organizational structure and staffing

1. The Department of Economic Affairs has a Head of Department, no more than two Deputy Heads, and specialized civil servants.

a) The Head of the Department is accountable to the People's Committee, the Chairman of the People's Committee of the town, and the law for fulfilling the Department's functions, tasks, and powers; they must report on departmental activities to the People's Council and the People's Committee of the town as required and collaborate with the heads of specialized agencies and political-social organizations at the district level to address issues pertinent to the Department's responsibilities;

b) The Deputy Heads assist the Head in overseeing various aspects of the Department's work and are responsible to the Head for their designated duties. In the absence of the Head, one Deputy Head is authorized to manage the Department's operations;

c) The appointment of the Head and Deputy Heads is at the discretion of the Chairman of the People's Committee of the town, following the established criteria set by the relevant authority and in compliance with legal regulations. Decisions regarding dismissal, transfer, rotation, commendation, disciplinary actions, resignation, retirement, and the implementation of policies concerning the Head and Deputy Heads are also made by the Chairman of the People's Committee of the town, adhering to legal guidelines and management frameworks.

2. Specialized civil servants are assigned to positions in accordance with approved job descriptions by the competent authority, covering the various fields under the Department's management.

3. The staffing levels for civil servants in the Department of Economic Affairs are determined by the Chairman of the People's Committee of the town within the overall civil service allocations designated to the People's Committee by the competent authority.

Chapter III

ORGANIZATION FOR IMPLEMENTATION

 

Article 4. The Head of the Department of Economic Affairs of the Town and the Heads of relevant agencies and units are responsible for implementing these Regulations. Should there be any amendments or additions to functions and duties during the implementation process, they shall propose revisions to the People's Committee of the town for appropriate adjustments to the Regulations./.
