    REGULATIONS

On functions, duties, powers, organizational structure and staffing of

the Culture - Sports and Broadcasting Center of Dong Hoa Town

Chapter I

POSITIONS, FUNCTIONS, DUTIES AND POWERS

Article 1. Positions and functions

1. The Culture - Sports and Broadcasting Center is a public service entity under the Dong Hoa Town People's Committee, tasked with advising and assisting the Committee in the execution of its responsibilities related to the Development of culture, sports, and tourism; organization of propaganda activities that disseminate the Party's guidelines and policies, as well as the policies and laws of the State; implementation of the political, economic, and socio-cultural objectives of the locality; provision of professional guidance to personnel engaged in cultural, sports, and tourism work at the grassroots level; organization and delivery of public services; addressing the community's needs for cultural, artistic, physical, and sporting activities; fulfilling the demand for information dissemination, enhancing public awareness, and catering to the cultural creativity and enjoyment of the local population; serving as the propaganda agency for the local Party Committee and government.

2. The Culture - Sports and Broadcasting Center possesses legal personality, along with its own seal and distinct bank accounts. It operates under the direct supervision and management of the Dong Hoa Town People's Committee in accordance with its authority and is also subject to guidance, inspection, and oversight regarding the professional expertise from the Phu Yen Department of Information and Communications, the Phu Yen Department of Culture, Sports and Tourism, and the Phu Yen Radio and Television Station.

Article 2. Duties and powers

1. In the Field of Culture, Sports, and Tourism

a) Based on the town’s socio-economic development program and work plan, the Culture-Sports and Broadcasting Center of the town shall proactively develop both short-term and long-term action plans, submit them to the People's Committee of Dong Hoa Town, and implement them upon approval by the People's Committee;

b) Organize cultural and artistic activities, propaganda and agitation, reading sessions, recreational events, film screenings, clubs, interest groups, and art talent classes;

c) Organize physical and sports activities; provide technical guidance, training methods, and conditions for organizations and individuals;

d) Host festivals, contests, performances, and competitions, and foster cultural, artistic, and sports movements at the grassroots level;

dd) Identify and nurture talents in culture, arts, and sports;

e) Collect, preserve, and promote folk arts and traditional sports;

g) Conduct professional activities and provide cultural and sports services, as well as other services in order to satisfy the needs of the local and in compliance with legal regulations, based on the organization’s resources;

h) Collaborate and engage in professional exchanges in culture, sports, and tourism with entities both within and outside the province, including centrally-administered cities;

i) Manage and promote tourism development; exploit financial mechanisms;

k) Provide services related to culture and sports;

l) Manage officials, personnel, finances, and assets in accordance with legal regulations.

2. In the Field of Broadcasting

a) Produce and broadcast radio programs in Vietnamese and ethnic languages via equipped loudspeaker systems and broadcast equipment to propagate the Party’s guidelines and policies, State laws, focusing on the local government's directives, community activities, dissemination of scientific-technical knowledge, economic, cultural, and social affairs, security work, and positive examples of people and deeds to the public in accordance with legal regulations;

b) Relay and broadcast programs of the Voice of Vietnam, Vietnam Television, and the Provincial Radio and Television Stations, serving the information needs of citizens as prescribed by law;

c) Directly manage specialized technical systems to relay and broadcast radio and television programs according to legal requirements;

d) Coordinate with the Provincial Radio and Television Stations to produce radio and television programs for broadcasting on the Provincial Radio and Television Station;

dd) Manage and operate television relay stations and radio broadcasting stations in the area as assigned. Provide technical guidance and professional support to commune and ward radio stations within the locality;

e) Manage labor, assets, budget, and revenue from services; implement policies for officials and workers within the scope of management, according to the law;

g) Prepare regular and ad-hoc reports as requested by supervisory agencies. Participate in professional activities organized by supervisory agencies. Arrange reward and recognition activities following legal regulations;

h) Consult with the People’s Committee of the town and relevant authorities to strengthen and expand the broadcasting and television services in the locality;

i) Provide services related to radio broadcasting.

3. Perform other tasks assigned by the People's Committee and the Chairman of the People’s Committee of the town according to the law.

Chapter II

ORGANIZATIONAL STRUCTURE AND STAFFING

Article 3. Organizational structure and staffing

1. The Culture - Sports and Broadcasting Center of the town consists of one Director, no more than two Deputy Directors, and specific professional and operational divisions, including:

a. Administration and General Affairs.

b. Culture and Arts.

c. Physical Education, Sports, and Tourism.

d. Broadcasting and Communications.

2. The Director and Deputy Directors shall be appointed, dismissed, removed, permitted to resign, as well as subject to the commendation, disciplinary action, reassignment, rotation, and other regimes and policies by the Chairman of the People’s Committee of the town in accordance with the law and management hierarchy.

Article 4. Number of staffs

1. The number of employees of the Culture - Sports and Broadcasting Center of the town shall be assigned by the Chairman of the People’s Committee of the town based on the Center’s functions, duties, and job positions.

2. Based on the functions, tasks and job positions approved by competent authorities, each year the Culture - Sports and Broadcasting Center of the town shall prepare a staffing plan that ensures the fulfillment of its assigned tasks, which is then submitted to the appropriate authorities for approval as prescribed

Chapter III

WORKING REGIMES AND OPERATIONAL RELATIONSHIPS

Article 5. Working regime, tasks, powers and responsibilities of the Director and Deputy Directors

1. The Center operates under a centralized management regime, adhering to the internal working regulations of the Culture - Sports and Broadcasting Center and the working regulations of the People’s Committee of the town, in compliance with the principle of democratic centralism;

2. The Director serves as the head of the Center, responsible for directly administering, managing, and being accountable to the People’s Committee of the town and to the law for the fulfillment of assigned functions, duties, and powers. The Director is also responsible for reporting to the People’s Committee of the town and the Chairman of the People’s Committee and serves as the account holder of the Center;

3. The Deputy Director assists the Director in overseeing certain areas of operation, being accountable to the Director and to the law for their assigned duties. In the Director’s absence, one Deputy Director, as authorized by the Director, will manage the Center's operations; the Deputy Director is not permitted to delegate this authority to another individual;

4. All officers at the Center shall comply with the management, direction, operation and task assignments provided by the Director and Deputy Directors. They are required to strictly adhere to the Center’s working regulations, internal rules, and disciplinary standards. They shall be responsible to the Director, Deputy Directors and jointly responsible to superiors and the law for assigned tasks;

5. The Center holds regular weekly and monthly meetings to review the results of task performance, implement work plans, and discuss documents related to the organization and activities of the Center;

6. The Center shall be responsible for providing recommendations and proposals within the scope of its assigned duties and powers as prescribed.

Article 6. Operational relationships

1. Relationship with the Department of Culture, Sports, and Tourism of Phu Yen Province and the Department of Information and Communications of Phu Yen Province

The Culture - Sports and Broadcasting Center of the town shall be under the state management of the Department of Culture, Sports, and Tourism of Phu Yen Province and the Department of Information and Communications of Phu Yen Province, complying with prescribed reporting and information protocols.

2. Relationship with Radio and Television Station of Phu Yen Province

The Center receives professional guidance and advice on investment in broadcasting equipment in the town from the Radio and Television Station of Phu Yen Province during the process of establishing and developing the town’s broadcasting.

3. Relationship with the People’s Committee of Dong Hoa Town

The Culture - Sports and Broadcasting Center of Dong Hoa town operates under the direct and comprehensive leadership and direction of the People’s Committee of Dong Hoa Town, following mandated reporting protocols. It provides recommendations and consultation to the People’s Committee on matters within its function and scope of duties and raises any challenges encountered, enabling the Committee to provide necessary guidance.

4. Relationship with other Departments, Units, Mass Organizations of the town, and People’s Committees of other communes and wards

The Center collaborates with town departments, units, mass organizations, and the People’s Committees of communes and wards on the principle of shared responsibility and mutual support in fulfilling the town’s shared political objectives, in accordance with the working regulations of the People’s Committee of the town and other relevant regulations.

Chapter IV

FINANCE, ASSETS

 

Article 7. Financial regime

1. The Culture - Sports and Broadcasting Center is a public service unit under the People’s Committee of the town and is responsible for developing and submitting a self-management plan to the People’s Committee for approval;

2. The Center shall establish service fee rates and submit them to the People’s Committee for approval;

3. It shall prepare and complie with revenue and expenditure estimates in accordance with legal regulations.

Article 8. Responsibility for asset management and use

The Culture - Sports and Broadcasting Center shall be responsible for managing state-owned assets in accordance with laws governing the management and use of state assets at public service units.

Chapter V

ORGANIZATION FOR IMPLEMENTATION

Article 9. The Director of the Center shall be responsible for organizing the implementation of these Regulations for each official and employee at the unit;

Article 10. During the implementation process, if there are any changes or additions to functions, tasks, powers, and organizational structure in legal documents of higher legal value or if any difficulties arise, the Director of the Center shall coordinate with the Heads of relevant agencies and units to report to the People’s Committee of the town for consideration and appropriate adjustments./.
