REGULATION ON FUNCTIONS, DUTIES, POWERS, ORGANIZATIONAL STRUCTURE AND STAFFING OF THE DEPARTMENT OF HOME AFFAIRS OF DONG HOA TOWN

(Issued together with Decision No. 01/2022/QD-UBND, dated January 17, 2022 of the People's Committee of Dong Hoa town)

Chapter I

POSITIONS, FUNCTIONS, DUTIES AND POWERS

Article 1. Positions and functions

1. The Department of Home Affairs is a specialized agency under the People's Committee of the town, advising and assisting the People's Committee of the town in performing the state management function on: Organizational structure; job positions, civil servant rank structure and civil servant payroll in state administrative agencies and organizations; job positions, staff structure by professional title and number of employees in public service units; salaries for cadres, civil servants, public employees, contract workers in administrative agencies, organizations, public service units; administrative reform, reform of the civil service and public service regime; local government; administrative boundaries; cadres, civil servants, public employees; cadres, civil servants of communes, wards and non-professional workers in communes, wards, villages, residential groups; associations, non-governmental organizations; state documents and archives; beliefs and religions; youth; emulation and rewards.

2. The Department of Home Affairs has legal status, its own seal and account; is subject to the leadership and management of the town People's Committee in terms of organization, staffing and work, and is subject to the direction, inspection and guidance on expertise and profession of the Department of Home Affairs of Phu Yen province.

Article 2. Duties and powers

1. Submit to the town People's Committee:

a) Issue decisions under the authority of the Town People's Committee:

Planning, development plans and programs, measures to organize the implementation of tasks on sectors and fields of home affairs in the town;

Decentralize and delegate state management tasks on sectors and fields of home affairs to specialized agencies under the Town People's Committee and the People's Committees of communes and wards;

Specify the functions, duties, powers and organization of the Department of Home Affairs;

 

b) Issue directives and guidance documents according to sectors and fields of home affairs for agencies, organizations and units in the town according to the Party's regulations, the law and the direction of the superior state agency.

2. Submit to the Chairman of the town People's Committee for decision on the appointment of personnel under the authority of the Chairman of the town People's Committee according to the Party's regulations and the law.

3. Organize the implementation of legal documents, planning, plans and programs after being approved by competent authorities; guide, inspect, inform, propagate, disseminate, educate on the law, monitor the implementation of the law in the fields under the assigned state management scope.

4. Regarding the organizational structure:

a) Advise and assist the town People's Committee to submit to the town People's Council for consideration and decision on the establishment, reorganization and dissolution of specialized agencies under the town People's Committee;

b) Appraisal of draft documents:

Regulate the functions, duties, powers and organization of administrative agencies and public service units under the town People's Committee;

Establish, reorganize and dissolve administrative organizations and public service units under the decision-making authority of the town People's Committee (except in cases where specialized laws have other provisions on the appraisal agency);

Establish, consolidate, merge and dissolve inter-sectoral coordination organizations under the decision-making authority of the Chairman of the town People's Committee according to the provisions of law.

5. Regarding job positions, civil servant payroll and civil servant rank structure:

a) Appraise job position projects, job position adjustment projects and civil servant rank structure of agencies and organizations under the management of the town People's Committee; synthesize and submit to the town People's Committee for decision according to authority or submit to the Provincial People's Committee for decision according to the provisions of law and the management decentralization of the Provincial People's Committee;

b) Advise and assist the town People's Committee:

Appraise and submit to the Provincial People's Committee the annual civil servant payroll plan or adjust the civil servant payroll of the town People's Council and the town People's Committee;

Implement the assignment of civil servant payroll to agencies and organizations under the People's Council and the town People's Committee within the total number of civil servant payrolls assigned by competent authorities and according to the management decentralization of the Provincial People's Committee;

c) Synthesize the structure of civil servant ranks of agencies and organizations under the town People's Council and the town People's Committee, submit to the People's Committee of the town to send to the Department of Home Affairs of Phu Yen province for general synthesis according to the provisions of law.

6. Regarding job positions, the structure of civil servants according to professional titles and the number of employees in public service units:

a) Appraise the project of job positions, the project of adjusting job positions and the structure of civil servants according to professional titles of public service units that have not self-insured regular expenses under the management scope of the town People's Committee. Submit to the town People's Committee for approval according to its authority or submit to the Provincial People's Committee for approval, adjust job positions and the structure of civil servants according to professional titles of public service units that have not self-insured regular expenses under the management scope;

b) Advise and assist the town People's Committee:

Appraise and submit to the Provincial People's Committee the plan for the number of employees of public service units that have not self-financed regular expenses within the scope of management;

Decide to assign and adjust the number of employees receiving salaries from the state budget for public service units that have not self-financed regular expenses and the number of employees receiving salaries from career revenue sources for each career unit that partly self-financed regular expenses within the scope of management after being assigned by competent authorities and according to the management decentralization of the Provincial People's Committee;

c) Synthesize job positions, staff structure by professional title and the number of employees in public service units according to the level of financial autonomy (due to the state budget ensuring regular expenses; partly financing regular expenses; self-financing regular expenses; self-financing regular expenses and investment expenses) within the scope of management of the town, submit to the town People's Committee to send to the Department of Home Affairs of Phu Yen province according to the provisions of law.

7. Regarding the implementation of salary, allowance, living expenses and bonus regimes and policies for cadres, civil servants, public employees and contract workers in administrative agencies, organizations and public service units:

a) Advise and submit to the Chairman of the town People's Committee to decide within his authority or propose to competent authorities to decide on regular salary increases, early salary increases and implementation of regimes and policies on salaries, allowances, living expenses and bonuses for cadres, civil servants, public employees and contract workers according to the provisions of law and the management decentralization of the Provincial People's Committee;

b) Guide, inspect and resolve within his authority or propose to competent authorities to resolve difficulties in the implementation of regimes and policies on salaries, allowances, living expenses and bonuses for cadres, civil servants, public employees and contract workers in administrative agencies, organizations and public service units in the town according to the provisions of law and the management decentralization of the Provincial People's Committee.

8. Regarding administrative reform, reform of the civil service and public service regime:

a) Advise and submit to the town People's Committee:

Decide to assign specialized agencies under the town People's Committee to preside over or coordinate the implementation of the contents and tasks of administrative reform, reform of the civil service and public service regime;

Decide to perform measures to promote administrative reform, reform of the civil service and public service regime in the town;

b) Advise and assist the town People's Committee in monitoring and inspecting specialized agencies at the same level and the People's Committees of communes and wards in implementing administrative reform, reform of the civil service and public service regime in the town.

9. Regarding local government:

a) Advise and assist the town People's Committee:

Implement the election of National Assembly deputies and People's Council deputies at all levels in the town according to the provisions of law and instructions of higher-level state agencies;

Submit to the town People's Council to elect, dismiss, and remove the Chairman, Vice Chairman and members of the town People's Committee according to the provisions of law;

Submit to competent authorities for consideration and decision on the establishment, dissolution, merger, and division of villages and residential groups; naming and renaming of villages and residential groups in the town;

Implement democratic work in communes, wards and in state administrative agencies and public service units; and the government's mass mobilization work according to the provisions of the Party, the law and instructions of higher-level state agencies;

b) Appraise and submit to the Chairman of the town People's Committee for approval the results of election, dismissal, removal of the Chairmen and Vice Chairmen of the People's Committee of the communes and wards; the transfer, temporary suspension from work, dismissal of the Chairmen and Vice Chairmen of the People's Committee of the communes and wards and the delegation of authority to the Chairmen of the People's Committee of the communes and wards according to the provisions of law;

c) Advise and assist the People's Committee and the Chairman of the town People's Committee in performing state management of villages and residential groups according to the provisions of law and the management decentralization of the Provincial People's Committee.

10. Regarding administrative unit boundaries:

Advise and assist the town People's Committee:

a) Submit to competent authorities for consideration and decision on projects to establish, dissolve, merge, divide, adjust administrative unit boundaries, name, rename administrative units and resolve disputes related to administrative unit boundaries at district, commune and ward levels; recognition of classification of administrative units at district, commune and ward levels; recognition of island communes, safe zone communes, safe zone areas;

b) Manage records, landmarks, and maps of administrative unit boundaries of the town, commune and ward in the locality according to the provisions of law and instructions of superior state agencies;

c) Implement projects and documents related to administrative unit boundaries after being decided by competent authorities.

11. Regarding cadres, civil servants and public employees; Cadres, civil servants of communes, wards and non-professional workers in communes, wards, villages and residential groups:

Advise and assist the town People's Committee:

a) Carry out the recruitment, use and management of cadres, civil servants, public employees, cadres, civil servants of communes, wards and non-professional workers in communes, wards, villages and residential groups under the management authority of the town People's Committee according to the regulations of the Party, the law and the management decentralization of the Provincial People's Committee;

b) Carry out training and fostering for cadres, civil servants, public employees, cadres, civil servants of communes, wards and other subjects according to the regulations of the law and the management decentralization of the Provincial People's Committee.

12. Regarding associations and non-governmental organizations:

Advise and assist the town People's Committee in performing state management of associations, social funds, charity funds, and domestic non-governmental organizations in accordance with the provisions of law, the management decentralization of the Provincial People's Committee, and the authorization of the Chairman of the Provincial People's Committee.

13. Regarding state documents and archives:

Advise and assist the town People's Committee in organizing, guiding, and inspecting the implementation of regimes and regulations on state documents and archives for agencies and organizations in the town, commune, and ward in accordance with the provisions of law and the management decentralization of the Provincial People's Committee.

14. Regarding beliefs and religions:

Advise and assist the town People's Committee:

a) State management of religious activities and religious establishments that are not historical, cultural, or scenic relics that have been ranked or included in the inventory of relics of the town;

b) Solve specific issues related to beliefs and religions according to the provisions of law, the management decentralization of the Provincial People's Committee, and the guidance of the Department of Home Affairs of Phu Yen province.

15. Regarding youth:

a) Advise and assist the town People's Committee:

Organize the implementation of policies, laws, strategies, programs, plans, projects, and youth development projects in the town; building a team of cadres and civil servants to do state management work on youth;

Integrate youth development targets and objectives when developing local socio-economic development programs and plans annually and in each period, ensuring the legitimate and legal powers and interests of youth;

b) Resolve within authority or submit to competent authorities to implement mechanisms and policies for youth; resolve issues related to youth in accordance with the provisions of law and the management decentralization of the Provincial People's Committee;

c) Manage, exploit and publish statistical data on youth and youth development indexes in the town in accordance with the provisions of law.

16. Regarding emulation and rewards:

a) Advise and assist the town People's Committee in organizing emulation movements and implementing the Party's guidelines, policies and laws of the State on emulation and rewards in the town;

b) Appraise the commendation proposals of local collectives and individuals, submit to the Chairman of the town People's Committee for decision on commendation or propose to competent authorities to decide on commendation in accordance with the provisions of law;

c) Guide and inspect the implementation of emulation and reward plans and contents in the town; build, manage and use the Emulation and Reward Fund in accordance with the provisions of law;

d) Perform the regular duties of the Town Emulation and Reward Council.

17. Advise and assist the town People's Committee in guiding the People's Committees of communes and wards to perform duties and powers on home affairs in accordance with the provisions of law and the management decentralization of the Provincial People's Committee.

18. Research, apply science and technology and build, manage and store information systems to serve the state management of the Department of Home Affairs.

19. Synthesize, compile statistics, summarize, review and evaluate the implementation results for the assigned management areas. Carry out information and reporting to the People's Committee, the Chairman of the town People's Committee, the Department of Home Affairs of Phu Yen province and competent agencies on the implementation of assigned tasks according to the provisions of law.

20. Manage the organizational structure; job positions, civil servant payroll, civil servant rank structure and implement regimes and policies for civil servants of the Department of Home Affairs according to the provisions of law and the management decentralization of the Provincial People's Committee.

21. Manage and be responsible for the finance and assets assigned according to the provisions of law and the management decentralization of the town People's Committee.

22. Implement regulations on preventing and combating corruption and negativity; practice thrift, combat waste and other regulations on internal management at the Department of Home Affairs.

23. Inspect, receive citizens, resolve complaints, recommendations, reflections and handle according to authority or advise competent authorities to handle violations in assigned fields according to law.

24. Perform other tasks assigned by the People's Committee, Chairman of the town People's Committee and according to law.

Chapter II

ORGANIZATIONAL STRUCTURE AND STAFFING

Article 3. Organizational structure and staffing

1. The Department of Home Affairs has a Head, no more than 02 Deputy Heads and civil servants performing professional and technical work:

a) The Head of the Department of Home Affairs is responsible to the town People's Committee, the Chairman of the town People's Committee and before the law for the implementation of the assigned functions, tasks, powers and all activities of the Department of Home Affairs;

b) The Deputy Head of the Department of Home Affairs assists the Head of the Department in charge of and monitors some aspects of the work; is responsible to the Head of the Department and before the law for the assigned tasks. When the Head of the Department is absent, a Deputy Head of the Department is authorized by the Head of the Department to manage the activities of the Department;

c) The appointment, transfer, rotation, reward, discipline, dismissal, resignation, implementation of regimes and policies for the Head and Deputy Head of the Department are decided by the Chairman of the town People's Committee in accordance with the provisions of law.

2. The civil service staffing of the Department of Home Affairs is decided by the Chairman of the town People's Committee within the total civil service staffing of the town assigned by the Provincial People's Committee.

The assignment of work to civil servants of the Department of Home Affairs must be based on the job position, civil service rank standards and the qualities, qualifications and abilities of the civil servants.

Chapter III

ORGANIZATION FOR IMPLEMENTATION

Article 4. The Head of the Department of Home Affairs and Heads of relevant agencies and units are responsible for implementing this Regulation. During the implementation process, if there are any amendments or supplements to functions and duties, the town People's Committee shall consider amending and supplementing the Regulation accordingly./.
