REGULATIONS

On the functions, duties, powers, organizational structure and staffing of the Department of Labor, War Invalids and Social Affairs of Dong Hoa town

Chapter I

POSITIONS, FUNCTIONS, DUTIES AND POWERS

Article 1. Positions and functions

1. The Department of Labor, War Invalids and Social Affairs is a specialized agency under the People's Committee of the town, responsible for advising and assisting the People's Committee in performing state management functions regarding: Labor, wages in the business sector, and employment; vocational education (excluding pedagogy); social insurance; occupational safety and hygiene; individuals with meritorious service; social assistance; children; gender equality; and the prevention of social evils in accordance with legal regulations; contributing to ensuring the uniform management of the sector or area of work at the local level.

2. The Department of Labor, War Invalids and Social Affairs has legal status, possesses a seal and bank account; it is subject to the direction and management concerning organization, job positions, civil servant staffing, civil servant classification structure, and its operations by the People's Committee of the town, while also being under the professional direction, inspection, and guidance of the Department of Labor, War Invalids and Social Affairs.

Article 2. Duties and powers

1. Submit to the People's Committee of the town the drafted decisions, medium-term and annual development plans, and programs and measures for organizing the implementation of state administrative reform tasks within the assigned areas of state management; drafted documents detailing the functions, tasks, powers, and organizational structure of the Department of Labor, War Invalids and Social Affairs under the People's Committee of the town.

2. Present to the Chairman of the People's Committee of the town drafts of documents regarding labor, individuals with meritorious service, and social affairs within the authority of the Chairman of the People's Committee as assigned.

3. Organize the implementation of legal documents, plans, and strategies after approval; provide information, dissemination, and legal education in the fields of labor, individuals with meritorious service, and social affairs; and monitor the implementation of laws.

4. Assist the People's Committee of the town in performing state management duties in accordance with the law regarding collective economic organizations, private economic organizations, associations, and non-governmental organizations operating in the fields of labor, individuals with meritorious service, and social affairs.

5. Guide and inspect the implementation of regulations concerning social assistance facilities, vocational education institutions, employment service organizations, drug rehabilitation centers, victim support facilities, organizations providing gender equality support services, services for preventing and responding to gender-based violence, and child assistance facilities in the area in accordance with the law and as assigned or authorized.

6. Oversee the management of memorial sites for fallen soldiers and soldiers' graves in the area according to the established delegation of authority.

7. Receive applications and determine the number of workers temporarily suspended from participating in social insurance for agencies, units, organizations, and businesses under the management of the People's Committee of the town requesting to temporarily cease contributions to the pension and survivorship fund; perform state management regarding social insurance at the local level in accordance with legal regulations and as assigned or authorized by the People's Committee of the town; review, inspect, and verify the list of individuals participating in health insurance as managed by the Ministry of Labor, War Invalids and Social Affairs.

8. Provide professional guidance in the areas of labor, individuals with meritorious service, and social affairs to officials and civil servants at the commune and ward levels.

9. Collaborate with various sectors and mass organizations to foster a community movement dedicated to caring for and assisting individuals with meritorious service to the revolution and other social policy beneficiaries.

10. Conduct inspections within the assigned sectors regarding compliance with legal regulations by organizations and individuals; resolve complaints and denunciations; and combat corruption and waste according to legal stipulations and the directives of the People's Committee of the town.

11. Facilitate the application of scientific and technological advancements; develop information and archival systems to support state management and the specialized functions of the town's relevant agencies.

12. Implement information management and prepare periodic and ad-hoc reports on the status of task execution as required by the People's Committee of the town and the Department of Labor, War Invalids and Social Affairs.

13. Manage the organizational structure, job positions, civil servant staffing, classification structure, salary regimes, policies, benefits, rewards, disciplinary actions, and professional development for civil servants under the department's jurisdiction, following legal regulations and the directives of the People's Committee of the town.

14. Manage and be accountable for the finances and assets of the Department of Labor, War Invalids and Social Affairs in compliance with legal regulations and the directives of the People's Committee of the town.

15. Perform other tasks assigned by the People's Committee of the town or as stipulated by law.

Chapter II

ORGANIZATIONAL STRUCTURE AND STAFFING

Article 3. Organizational structure and staffing

1. Organization: The Department of Labor, War Invalids and Social Affairs consists a Head of Department, no more than 02 Deputy Heads, and civil servants who carry out specialized and professional tasks.

a) The Head of the Department of Labor, War Invalids and Social Affairs is the leader of the Department and is responsible to the People's Committee of the town, the Chairman of the People's Committee of the town, and the law for all activities of the Department of Labor, War Invalids and Social Affairs.

b) The Deputy Head of the Department of Labor, War Invalids and Social Affairs assists the Head in managing and monitoring certain areas of work and is accountable to the Head and to the law for the assigned tasks. When the Head is absent, one Deputy Head is authorized by the Head to manage the activities of the Department of Labor, War Invalids and Social Affairs.

c) The appointment, reappointment, dismissal, transfer, rotation, reward, discipline, resignation, retirement, and implementation of other regimes and policies for the Head and Deputy Heads of the Department are decided by the Chairman of the People's Committee of the town.

2. Staffing: The staffing of the Department of Labor, War Invalids and Social Affairs is assigned based on job positions, linked to its functions, duties, scope of activities, and is part of the total civil servant staffing in the administrative agencies and organizations of the town as assigned by the competent authority.

The assignment of work to civil servants in the Department of Labor, War Invalids and Social Affairs is based on job positions, civil servant classification standards, and the qualities, qualifications, and capabilities of the civil servants.

Chapter III

ORGANIZATION FOR IMPLEMENTATION

 

Article 4. The Head of the Department of Labor, War Invalids and Social Affairs and the Heads of relevant agencies and units are responsible for implementing these Regulations. Should there be any amendments or additions to functions, duties, powers, organizational structure and staffing of the Department of Labor, War Invalids and Social Affairs during the implementation process, they shall propose revisions to the People's Committee of the town for appropriate adjustments to the Regulations./.
