REGULATIONS

ON THE FUNCTIONS, TASKS, POWERS, ORGANIZATION, AND STAFFING

OF THE DEPARTMENT OF EDUCATION AND TRAINING OF DONG HOA TOWN

(Promulgated together with Decision No.: 04/2023/QD-UBND,

dated July 14, 2023, of the People's Committee of Dong Hoa Town)

Chapter I

POSITION, FUNCTIONS, TASKS, AND POWERS

Article 1. Position and Functions

  1. The Department of Education and Training is a specialized agency under the People’s Committee of the town, tasked with advising and assisting the People’s Committee in state management of education at the local level in accordance with legal regulations and carrying out tasks and powers as delegated and authorized by the People’s Committee and the Chairman of the People’s Committee.
  2. The Department of Education and Training has legal status, its own seal, and a bank account as stipulated by law; it is subject to the direction and management regarding organization, job positions, staffing, and tasks from the People’s Committee, while also receiving professional direction, guidance, and inspection from the Department of Education and Training of Phu Yen Province.

Article 2. Tasks and Powers

The Department of Education and Training performs tasks and powers stipulated in Article 13 of Decree No. 127/2018/ND-CP dated September 21, 2018, on state management responsibilities in education; Decree No. 46/2017/ND-CP dated April 21, 2017, on conditions for investment and operation in education; Decree No. 135/2018/ND-CP dated October 4, 2018, amending and supplementing certain provisions of Decree No. 46/2017/ND-CP; other relevant legal regulations; and the following specific tasks and powers:

  1. Lead and coordinate with relevant agencies to submit to the People’s Committee:
  1. Issuance of guiding documents, implementation of legal regulations on education; development plans, programs, and projects for preschool, primary, and secondary education in the town after approval from competent authorities; implementation plans for the Scheme to renew curricula and general education textbooks in line with Phu Yen Province’s plans; and legal documents on education as authorized.
  2. Approval of the Scheme for reorganizing preschools, primary, and secondary schools in the town based on local conditions, ensuring sufficient educational management personnel, a sufficient number of staff as per the approved job position plan, and meeting conditions for ensuring the quality of education.
  1. Lead and coordinate with relevant agencies to perform the state management function of the People’s Committee over education as delegated by the Government.
  2. Conduct recruitment, utilization, and training of teachers, educational management staff, and staff within public educational institutions under the authority of the People’s Committee as delegated.
  3. Manage educational and teaching activities both within and outside schools; direct the implementation of moral, lifestyle, and school safety education; implement the scheme for renewing curricula and general education textbooks; and perform education communication on the town’s area.
  4. Regularly update information on teachers and educational management staff within the management scope in the education sector database. Complete and timely submit annual public reports on the town’s education sector within its management scope to the People’s Committee and Phu Yen Province’s Department of Education and Training as required.

Chapter II

ORGANIZATION AND STAFFING

Article 3. Organization and Staffing

  1. The Department of Education and Training consists of a Head, up to two Deputy Heads, and specialized civil servants:
  1. The Head of the Department of Education and Training is responsible to the People’s Committee, the Chairman of the People’s Committee, and the law for carrying out assigned functions, tasks, and powers, and the overall operations of the Department of Education and Training. The Head also carries out tasks delegated by the Chairman of the People’s Committee.
  2. The Deputy Heads of the Department assist the Head in managing and overseeing specific work areas; they are accountable to the Head and the law for the tasks assigned. When the Head is absent, a Deputy Head, as authorized by the Head, will lead the department’s operations.
  3. The Chairman of the People’s Committee decides on the appointment, transfer, evaluation, commendation, discipline, dismissal, resignation, and implementation of other regimes and policies for the Head and Deputy Heads in accordance with the law.
  1. The civil servant staffing of the Department of Education and Training is decided by the Chairman of the People’s Committee within the total civil servant staffing assigned to the town by the Provincial People’s Committee.

Work assignments for civil servants in the Department of Education and Training must be based on job positions, civil servant rank standards, and the qualifications, abilities, and competencies of the civil servants.

Chapter III

IMPLEMENTATION

Article 4. The Head of the Department of Education and Training, along with heads of relevant agencies and units, is responsible for implementing this Regulation. If there are any amendments or additions to the functions and tasks during the implementation process, proposals should be submitted to the People’s Committee for consideration and appropriate amendments and additions./.
